Two suspects indicted in laughing gas smuggling case

Two people at a tech company in Miaoli have been indicted in a case that dates back 2021, when a large illegal shipment of a drug known as laughing gas was seized at Taiwan’s border, prosecutors said Thursday.

In a statement, the Miaoli District Prosecutors Office said the company’s owner surnamed Wei (?) and an employee surnamed Hsiao (?) were indicted on charges of attempting to obtain unlawful gain by fraud.

The charges stemmed from a case in 2021, when Keelung Customs officers intercepted and seized 54 tons of nitrous oxide, commonly known as laughing gas, which had been shipped in three containers from Hong Kong, prosecutors said.

The contents of the containers had been falsely declared as shielding gases, which are used in industrial welding to prevent bubbles and splatters, according to prosecutors.

The 54 tons of laughing gas, which could have filled 10,800 5-liter canisters, was the single largest volume ever seized by customs officers in Taiwan, prosecutors said.

A special task force assigned to the case later obtained a warrant to search the tech company in Miaoli, and Wei and Hsiao were summoned for questioning, prosecutors said.

They both denied any involvement in the case, and they said the laughing gas may have been mistakenly shipped to Taiwan by the seller, according to prosecutors.

After careful examination of the relevant documents, however, the task force concluded that the two suspects had sought to smuggle the laughing gas into Taiwan for illegal gain, prosecutors said.

In Taiwan, the government has banned the illegal sale, purchase and use of nitrous oxide.

The gas is used legitimately in hospitals, at dental surgeries and in professional kitchens, but supplying it for its psychoactive effects is illegal.

Excessive inhalation of the gas could cause breathing difficulties, chest tightness and even death, according to authorities.

President Tsai seeks Canada’s support for Taiwan’s CPTPP bid

President Tsai Ing-wen (???) on Thursday expressed hope that Canada would support Taiwan’s bid to join a cross-national trade pact, during a meeting with the country’s representative to Taiwan Jim Nickel.

Taiwan’s ascension to the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) would allow Taiwan and Canada to work together to promote economic prosperity, as the two nations have complementary economies, Tsai said.

Taiwan applied in September 2021 to join the CPTPP, which is one of the world’s biggest trade blocs, representing a market of 500 million people and accounting for 13.5 percent of global trade.

Any new ascension to the trade pact requires the unanimous support of its signatories, which currently include Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, and Vietnam.

Hence, the government is keen to join the trade bloc ahead of China, which submitted its CPTPP application less than a week prior to Taiwan, to avoid a situation where Beijing could veto Taiwan’s ascension.

Taiwan’s Office of Trade Negotiations said in January that the government would seek the approval of the CPTPP’s member states to establish “a working group” in 2023 to review Taiwan’s application.

The trade bloc’s commission is currently in negotiations with the United Kingdom, which submitted a formal request to join the trade bloc in February 2021.

Meanwhile, Tsai expressed hope that Taiwan and Canada would further broaden bilateral collaboration with the help of Nickel, who took up the post of executive director of the Canadian Trade Office in Taipei last September.

Taichung bus driver indicted after fatal crosswalk accident

A Taichung City bus driver was indicted Thursday for negligent homicide after he plowed into a family legally crossing a crosswalk in the city’s North District last December, killing a 31-year-old woman and her 1-year-old son.

As his failure to give way resulted in two deaths, prosecutors asked that the court hand a heavy sentence to the 53-year-old driver, identified by his last name Chen (?).

According to Taichung District Prosecutors Office, the accident occurred as the woman, her husband, and child were legally crossing Yingcai Rd. at the intersection with Xueshi Rd. at around 11:15 p.m. on Dec. 27 last year.

As they were crossing, a No. 280 city bus made a left turn on a green light into Yingcai Rd. apparently failing to see the two adults and their child in a stroller.

After the accident the three were immediately taken to China Medical University Hospital, where the mother, surnamed Lee (?), and her child were pronounced dead. The father, an Iraqi national, was treated for minor injuries.

The father, identified by the Chinese surname Chi (?), told media after the crash that they had been walking across the crosswalk and had almost reached the other side of the road when the bus, moving at high speed, made a left turn into them.

His account was confirmed by witnesses, who said the family had been legally crossing the crosswalk but appeared to have been in the driver’s “blind spot,” as he made no attempt to slow down before the accident.

During police questioning, Chen said at the time he had not seen the family due to the poor lighting in the area, and only realized something had happened after feeling a “bump” at the back end of the bus.

Based on video footage taken from the bus dashcam and nearby surveillance cameras, prosecutors investigating the case later determined that Chen’s vision could not have been hampered by lighting nor the weather and that as such his excuse was invalid.

Supreme court upholds 13-year sentence in child abuse death case

The Supreme Court recently upheld the sentence of 13 years and two months in prison handed down by a lower court to the live-in boyfriend of a woman whose 3-year-old daughter died at a hospital in Tainan in 2021 after being subjected to long-term physical abuse.

The girl was born to the woman surnamed Fang (?) and her ex-husband but had initially been looked after by relatives. However, on July 1, 2021, Fan took the child back to Tainan to live with her and her boyfriend surnamed Hu (?), according to law enforcement.

From late July to late August 2021, the couple often became infuriated when the child cried and frequently beat her with a mop handle or their bare hands, according to authorities.

In the early morning of Aug. 29, Fang and Hu returned home to find the girl listless and unable to control her bowel movements. However, they did not take her to a hospital until the next night after Hu once again beat the child, resulting in her falling into a coma.

The girl died of her injuries later that day at National Cheng Kong University Hospital.

On January 19, 2022, Tainan District Court sentenced Fang to 13 years and six months and Hu to 13 years and two months for the abuse of the child, hindering development and causing her death in violation of the “Implementation Act of the Convention on the Right of the Child.”

In October last year, the High Court Tainan Branch upheld the sentences handed down to Fang and Hu.

Fang did not appeal against the ruling, while Hu’s appeal was rejected by the Supreme Court. The judgment is final.
